1. Agreement to Terms

By accessing and using FinexaVision Financial Audit Services ("FinexaVision," "we," "our," or "us"), you accept and agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our services or website.

2. Service Description

FinexaVision provides professional financial audit services to businesses across Canada, including:

  • Financial statement audits and reviews
  • Internal controls assessment
  • Compliance verification and reporting
  • Risk assessment and management consulting
  • Financial transparency and advisory services

3. Service Packages and Pricing

Our Audit Services:

  • Basic Audit ($750): Financial statement review, basic compliance check, written report
  • Business Audit ($1,950): Comprehensive analysis, controls assessment, detailed recommendations
  • Pro Audit ($3,500): Full audit, advanced risk assessment, ongoing support

All prices are in Canadian dollars (CAD) and may be subject to applicable taxes. Custom quotes available for specialized audit requirements.

4. Client Obligations and Responsibilities

As our client, you agree to:

  • Provide accurate and complete financial information and documentation
  • Grant reasonable access to records, personnel, and business premises as needed
  • Respond promptly to audit inquiries and requests for clarification
  • Maintain confidentiality of audit methodologies and preliminary findings
  • Pay agreed fees according to the specified payment terms
  • Implement recommended improvements in good faith where applicable

5. Professional Standards and Compliance

Our audit services are performed in accordance with:

  • Canadian Generally Accepted Auditing Standards (GAAS)
  • International Standards on Auditing (ISA) where applicable
  • Provincial regulatory requirements and professional codes of conduct
  • Relevant industry-specific financial reporting standards

6. Confidentiality and Data Protection

We maintain strict confidentiality regarding all client information and business affairs. Our confidentiality obligations include:

  • Protection of sensitive financial and business information
  • Secure handling and storage of client documents and data
  • Non-disclosure of audit findings to unauthorized parties
  • Compliance with Canadian privacy legislation and professional standards

7. Limitation of Liability

Important Notice: Our liability is limited as follows:

  • Our total liability shall not exceed the fees paid for the specific audit engagement
  • We are not liable for consequential, indirect, or punitive damages
  • Liability is limited to direct damages resulting from our negligent performance
  • Claims must be brought within one year of the audit report completion

8. Audit Report Limitations

Our audit reports are subject to inherent limitations:

  • Audits provide reasonable, not absolute, assurance about financial statements
  • Some misstatements may not be detected due to audit methodology limitations
  • Reports are intended for specified users and purposes only
  • Future performance cannot be guaranteed based on historical audit findings

9. Payment Terms and Conditions

  • Payment is due within 30 days of invoice date unless otherwise agreed
  • Late payments may incur interest charges at 1.5% per month
  • Disputed charges must be raised within 10 days of invoice receipt
  • We reserve the right to suspend services for overdue accounts
  • All fees are non-refundable once audit work has commenced

10. Intellectual Property

All audit methodologies, templates, and proprietary processes remain the intellectual property of FinexaVision. Clients receive rights to use audit reports for their intended business purposes but may not reproduce our methodologies or processes.

11. Force Majeure

We are not liable for delays or failures in performance due to circumstances beyond our control, including natural disasters, government actions, cyber attacks, or other force majeure events.

12. Termination

Either party may terminate the audit engagement with written notice. Upon termination:

  • Client remains liable for fees incurred up to termination date
  • We will deliver work completed to termination date
  • Confidentiality obligations continue post-termination
  • Return or destruction of client materials will be arranged

13. Dispute Resolution

Any disputes will be resolved through:

  • Good faith negotiation as the first step
  • Mediation through a qualified Canadian mediator if needed
  • Binding arbitration under Canadian arbitration rules
  • Jurisdiction of Nova Scotia courts for legal proceedings

14. Governing Law

These Terms & Conditions are governed by the laws of Canada and the province of Nova Scotia. Any legal proceedings will be conducted in Nova Scotia courts.

15. Changes to Terms

We reserve the right to modify these terms with 30 days' notice to existing clients. Continued use of our services constitutes acceptance of modified terms.
